These Terms of Use (“Terms”) govern your access to and use of www.bluezerosecurity.com and any pages, content, features, or services made available through the website (collectively, the “Site”). The Site is owned and operated by Blue Zero Security, LLC (“Blue Zero,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree with them, please do not use the Site.
1. Purpose of the Site
The Site provides general information about Blue Zero, our experience, methodology, capabilities, and cybersecurity consulting services. Content provided through the Site is for general informational and educational purposes only. It is not intended to provide cybersecurity, legal, regulatory, compliance, financial, technical, or other professional advice for any specific organization or situation. You should not act or refrain from acting solely on the basis of information presented on the Site. Appropriate professional guidance should be obtained based on your organization’s specific circumstances, risks, systems, obligations, and objectives.
2. No Client Relationship
Accessing the Site, submitting a contact form, sending an email, or communicating with Blue Zero through the Site does not create a consulting, advisory, fiduciary, confidential, or client relationship. A client relationship is established only through a written agreement signed by Blue Zero and the applicable client. Blue Zero has no obligation to accept or respond to an inquiry, and no communication should be interpreted as acceptance of an engagement unless confirmed in a signed agreement.
3. No Confidentiality Through the Site
Information submitted through the Site’s general contact form or sent through ordinary email may not be treated as confidential unless Blue Zero has expressly agreed otherwise in writing. Do not submit:
- Passwords or access credentials
- Vulnerability details or exploit information
- Protected health information
- Financial account information
- Government identification numbers
- Export-controlled information
- Confidential client or employee data
- Sensitive system or network information
- Information subject to contractual or regulatory restrictions
If an engagement is established, the handling of confidential information will be governed by the applicable consulting agreement, nondisclosure agreement, or other written terms.
4. Permitted Use
You may use the Site only for lawful, legitimate, and noncommercial informational purposes. Subject to these Terms, Blue Zero grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for your own internal business or informational purposes. You may not use the Site in a manner that infringes the rights of Blue Zero or any other person, interferes with Site operations, or violates applicable law.
5. Prohibited Conduct
You agree not to:
- Access or use the Site for an unlawful, fraudulent, or malicious purpose
- Attempt to gain unauthorized access to the Site, its hosting environment, accounts, systems, or connected networks
- Scan, probe, test, or exploit the Site for vulnerabilities without prior written authorization
- Introduce malware, malicious code, automated attacks, or harmful technology
- Interfere with the availability, security, operation, or performance of the Site
- Circumvent access controls or security measures
- Use bots, scrapers, crawlers, or automated tools in a manner that burdens or disrupts the Site
- Impersonate another person or misrepresent your identity or affiliation
- Submit false, misleading, defamatory, unlawful, or infringing content
- Copy, reproduce, republish, distribute, sell, license, or commercially exploit Site content without permission
- Use Blue Zero’s name, trademarks, branding, or content to suggest an unauthorized endorsement or affiliation
- Use information from the Site to develop, train, market, or improve a competing commercial service without written authorization
Blue Zero may restrict or terminate access to the Site when it reasonably believes these Terms have been violated.
6. Intellectual Property
The Site and its original content, including text, graphics, designs, photographs, videos, logos, service descriptions, methodologies, reports, downloads, and other materials, are owned by or licensed to Blue Zero and are protected by applicable intellectual-property laws. “Blue Zero Security,” the Blue Zero name, associated logos, taglines, and other brand elements may be trademarks or service marks of Blue Zero. Nothing on the Site grants a license or right to use those marks without prior written permission. You may print or save a reasonable number of Site pages for your own internal, noncommercial reference. You may not alter, remove, or obscure copyright, trademark, attribution, or proprietary notices.
7. Blue Zero Methodology and Materials
Descriptions of the Blue Zero Methodology and related frameworks, processes, diagrams, assessments, models, roadmaps, and materials are provided to explain our general approach. Their publication on the Site does not grant permission to reproduce, implement, modify, distribute, teach, license, sell, or commercially exploit those materials. Specific deliverables created for a client are governed by the intellectual-property and usage provisions of the applicable written engagement agreement.
8. Third-Party Content and Links
The Site may contain links to third-party websites, publications, cybersecurity advisories, news sources, government resources, applications, or services. These links are provided for convenience and informational purposes. Blue Zero does not control and is not responsible for the availability, accuracy, security, privacy practices, content, products, or services of third parties. The inclusion of a link does not necessarily constitute an endorsement, sponsorship, partnership, or recommendation by Blue Zero. Your use of third-party websites and services is governed by their own terms and policies.
9. Accuracy and Availability
Blue Zero makes reasonable efforts to present useful and accurate information. However, cybersecurity threats, technologies, laws, regulatory guidance, standards, and industry practices change frequently. We do not guarantee that Site content is complete, current, accurate, or suitable for a particular purpose. We may modify, remove, suspend, or discontinue any portion of the Site without notice. We do not guarantee uninterrupted, timely, secure, or error-free access to the Site.
10. Security
Blue Zero uses reasonable measures designed to support the security and integrity of the Site. However, no website, network, communication method, or storage system can be guaranteed to be completely secure. You are responsible for using appropriate security practices when accessing the Site and for protecting your devices, systems, credentials, and information. The Site is not a channel for reporting an active incident, requesting emergency response, or transmitting time-sensitive security information. For an immediate threat or emergency, contact the appropriate internal personnel, service provider, law-enforcement agency, or emergency service.
11. Privacy
Our collection and use of personal information through the Site are described in our Privacy Policy. By using the Site, you acknowledge that you have reviewed the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
12. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and all content are provided on an “as is” and “as available” basis. Blue Zero disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, and freedom from harmful components. Blue Zero does not warrant that: The Site will satisfy your requirements; The Site will always be available, uninterrupted, or error-free; Site content will be complete, current, or accurate; Any identified issue will be corrected; Use of the Site will prevent cybersecurity incidents, losses, disruptions, or regulatory consequences. Some jurisdictions may not permit the exclusion of certain warranties, so portions of this section may not apply to you.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Blue Zero and its owners, officers, directors, employees, contractors, advisers, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Site. This includes damages arising from: Loss of data, revenue, profits, business opportunities, or goodwill; Business interruption; Security incidents; Reliance on Site content; Inability to access or use the Site; Third-party websites, content, applications, or services; Unauthorized access to or alteration of communications. To the fullest extent permitted by law, Blue Zero’s total liability for any claim arising from or related to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
14. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Blue Zero and its owners, officers, directors, employees, contractors, advisers, affiliates, licensors, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from: Your misuse of the Site; Your violation of these Terms; Your violation of applicable law; Your infringement of another person’s rights; Content or information you submit through the Site.
15. Changes to These Terms
We may update these Terms periodically to reflect changes in the Site, our services, technologies, business practices, or legal requirements. When changes are made, the “Last Updated” date at the top of the page will be revised. Material changes may be accompanied by an additional notice when appropriate. Your continued use of the Site after revised Terms become effective constitutes acceptance of the updated Terms.
16. Governing Law and Venue
These Terms and any dispute arising from or relating to the Site will be governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent permitted by applicable law, any legal action relating to the Site or these Terms must be brought in the state or federal courts located in Orange County, California, and you consent to the jurisdiction and venue of those courts.
17. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
18. Waiver
Blue Zero’s failure to enforce any provision of these Terms will not constitute a waiver of that provision or of the right to enforce it later.
19. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Blue Zero regarding your use of the Site. They do not replace or modify any signed consulting agreement, nondisclosure agreement, statement of work, or other written agreement between Blue Zero and a client. If a conflict exists, the signed agreement will govern the applicable client engagement.
